1. Parties and Acceptance

These Terms & Conditions ("Terms") govern access to and use of Trump-Meter, operated by [Company Name GmbH] (in Gründung), represented by Fabian Sandknop, In den Alboingärten 11, 12103 Berlin, Germany ("Provider", "we", "us").

By creating an account, subscribing to a paid plan, or using the service, you ("User", "you") accept these Terms in full. If you do not agree, do not use the service.

These Terms apply to all users worldwide. European consumer protection law applies to users resident in the EU/EEA.

2. Service Description

Trump-Meter is a web-based platform that collects publicly available news headlines, Truth Social posts, and market-related statements, scores them for likely impact on financial markets using AI language models, and presents the resulting sentiment scores alongside asset price data.

The service is provided on two tiers:

We reserve the right to modify features available on each tier with reasonable advance notice (see Section 13).

3. Account Registration

To access personalised features or subscribe to Pro, you must register with a valid email address and a password of your choice. You represent that:

• All registration information you provide is accurate and up to date.
• You are at least 18 years of age.
• You will maintain the confidentiality of your credentials and are solely responsible for all activity under your account.
• You will notify us immediately at info@trump-meter.com if you suspect unauthorised access.

One person or legal entity may hold one account. Creating multiple accounts to circumvent feature limits is prohibited.

4. Pro Subscription, Payment & Cancellation

4.1 Pricing

Pro subscriptions are available on a monthly or annual basis. Current prices are displayed at trump-meter.com/pro. All prices are in EUR and include applicable VAT. Prices may change; existing subscribers receive 30 days' notice before any price increase takes effect.

4.2 Free Trial

New subscribers receive a 7-day free trial. The trial begins when you enter payment details and confirm checkout. You will not be charged until the trial period ends. Cancel at any time before the trial expires to avoid being charged.

4.3 Billing

Subscriptions automatically renew at the end of each billing period (monthly or annual). Payment is processed by Stripe, Inc. on the renewal date using the payment method on file. You authorise us to charge the applicable fee on each renewal date. Failed payments may result in suspension of Pro features until the balance is resolved.

4.4 Cancellation

You may cancel your subscription at any time through the billing portal accessible from Account Settings or by emailing info@trump-meter.com. Cancellation takes effect at the end of the current billing period; you retain Pro access until that date. No refunds are issued for the unused portion of a billing period, except as required by applicable law.

4.5 Right of Withdrawal (EU Consumers)

Refunds are not provided for used subscription periods. Exceptions may be made at our sole discretion in cases of documented technical failure on our part that made the service inaccessible for a material portion of the paid period. Contact info@trump-meter.com with details.

5. Pro API Usage

Pro subscribers may generate an API key to access the Trump-Meter REST API. API usage is subject to the following:

• Rate limit: 500 requests per calendar day per API key.
• API keys may not be shared with third parties or used to build competing services without our prior written consent.
• API access is for personal or internal business use only.
• We reserve the right to revoke API keys that are misused or used in violation of these Terms.
• API availability is provided on a best-effort basis; no SLA is guaranteed on the Free or Pro tiers.

6. Acceptable Use

You agree not to:

• Use the service to engage in illegal activity or violate any applicable laws or regulations.
• Attempt to circumvent rate limits, authentication, or access controls.
• Scrape, crawl, or systematically extract data beyond your tier's permitted access.
• Use the service in a manner that places unreasonable load on our infrastructure.
• Redistribute, resell, or sublicense access to the service or its data without our written consent.
• Use automated tools to create accounts or bypass free-tier limitations.
• Use the service to disseminate misinformation, manipulate markets, or engage in market abuse as defined under MAR (EU Regulation 596/2014).
• Transmit viruses, malicious code, or interfere with the security of the platform.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice or refund.

7. No Financial Advice — Disclaimer

Trump-Meter provides information only. The sentiment scores, market overlays, predictive signals, and any other outputs:

• Are generated by AI models and may be inaccurate, incomplete, or misleading.
• Do not constitute financial, investment, trading, legal, or tax advice.
• Do not represent the views or recommendations of any regulated financial adviser.
• Are not a solicitation to buy or sell any financial instrument.

Financial markets involve risk. You may lose all of your invested capital. We strongly recommend consulting a qualified financial adviser before making any investment decisions. Any trading or investment activity you undertake based on material from this site is entirely at your own risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• We provide the service "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
• We do not guarantee uninterrupted or error-free operation of the service.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or trading losses arising from your use of the service.
• Our total aggregate liability for any claim arising from or related to these Terms or the service shall not exceed the amount you paid to us in the 3 months immediately preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law. EU consumer rights remain unaffected.

9. Intellectual Property

All intellectual property rights in the Trump-Meter platform, including software, design, branding, and original content, are owned by or licensed to us. These Terms do not grant you any rights in our intellectual property other than a limited, non-exclusive, revocable licence to use the service for its intended purpose.

News headline text sourced from third-party providers (Finnhub, Truth Social mirror, etc.) is subject to the respective third parties' terms. We do not claim ownership of such third-party content.

10. Account Termination

By you: You may delete your account at any time via Account Settings. Active paid subscriptions should be cancelled before deletion to avoid further charges.

By us: We may suspend or terminate your account for breach of these Terms, non-payment, or if we determine (in our sole discretion) that continued access poses a risk to the platform or other users. In non-urgent cases, we will provide 7 days' notice. In cases of serious breach (e.g. abuse, fraud), termination may be immediate.

On termination, your right to access the service ceases immediately. We may retain data as required by law (see Privacy Policy, Section 3).

11. Third-Party Services

The service integrates with third-party platforms (Stripe, Telegram). Your use of those platforms is subject to their respective terms and privacy policies. We are not responsible for the conduct of third-party services.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

For disputes with business users: exclusive jurisdiction is the competent court in Berlin, Germany.

For disputes with consumers resident in the EU/EEA: you may bring proceedings in the courts of your country of residence, and mandatory consumer protection laws of your country of residence continue to apply.

We are not obliged to participate in consumer arbitration proceedings and do not voluntarily do so. The EU ODR platform is available at ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify registered users by email and post a notice on the website at least 14 days before the changes take effect.

Continued use of the service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the service and cancel any active subscription before the effective date.

14. General Provisions

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
• Waiver: Failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the service and supersede all prior agreements.
• Assignment: We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets, provided the service continues under the same terms. You may not assign your account or rights without our consent.
• Language: These Terms are written in English. In the event of any conflict with a translation, the English version prevails.
